在所謂的民主國家中，廣義的言論自由是一項最重要的基本價值，而新聞自由的價值則是以此為基礎衍生而來的媒體權力（利）。在美國，以憲法第一修正案為此一價值的保障基礎。然而，雖然此一價值實為民主社會之基石，但愈往具體而實際的法律與實踐層次，則愈加出現一些彼此衝突與矛盾的價值、原則與功能。那麼，言論自由的實際意涵到底是什麼？而我們又應如何看待之？
